What is Safety Gate and how does it relate to GPSR?
Safety Gate is the European Union's rapid alert system for dangerous non-food products, managed by the European Commission. It replaced the former RAPEX system and now operates with a broader scope and faster coordination tools. The system connects market surveillance authorities from all 30 EEA countries — the 27 EU Member States plus Norway, Iceland, and Liechtenstein — enabling them to share information about dangerous products detected anywhere in the European market and coordinate their withdrawal in near real time. Safety Gate also operates a public portal at ec.europa.eu/safety-gate, where any consumer, business, or authority can search for alerts on specific products, brands, or categories. Appearing in this database is the most visible form of GPSR non-compliance and can destroy a brand's commercial reputation overnight.
The GPSR significantly strengthens Safety Gate's role and introduces new business-facing obligations around it. The most important is the Safety Business Gateway — a secure channel through which economic operators must report to EU authorities when they know or have reason to believe that a product they have placed on the market presents a serious risk. This reporting obligation under Article 20 applies to all products, including those also subject to sector-specific regulation, and must be fulfilled «without undue delay» from the moment the risk is identified. Separately, under Article 25, operators of online marketplaces must register with the Safety Gate Online Marketplace Module, giving authorities a direct point of contact for safety enquiries and recall coordination. Amazon, eBay, and Etsy manage their own registrations; operators of their own direct-to-consumer stores must register independently.
The practical message for any seller is this: Safety Gate is not just a theoretical risk. The EU Safety Gate 2024 Annual Report showed a record number of alerts, with electronics, toys, and clothing among the most frequently flagged categories. Many alerts are triggered by market surveillance checks of products sold online. The best insurance against a Safety Gate listing is having a solid, documented technical file that can demonstrate product safety proactively — before an authority investigates, not after.
What the law says
Article 20 of Regulation (EU) 2023/988: Manufacturers must report accidents caused by their products through the Safety Business Gateway without undue delay. Article 25: Online marketplace operators must register with the Safety Gate Online Marketplace Module. Both obligations apply from 13 December 2024.
Consequences of non-compliance
A Safety Gate listing is permanent, public, and searchable across 30 countries. It triggers coordinated withdrawal across all EU markets, disqualifies the product from any marketplace operating in the EU, and is routinely picked up by trade media. Failing to report a known risk via the Safety Business Gateway is a separate infringement with its own penalties up to €100,000.
