Do I need GPSR compliance to sell on Amazon EU?
Yes — without exception. Amazon has confirmed publicly that all sellers shipping non-food products to customers in the European Union must comply with Regulation (EU) 2023/988 (GPSR). This applies whether you are based in the EU, the US, the UK, China, or anywhere else in the world. What matters is the destination: if a consumer in Germany, France, Spain, Italy, or any other EU Member State receives your product, the GPSR governs that transaction. Amazon began enforcing this on 13 December 2024 and is continuing to enforce it actively, deactivating non-compliant listings without prior warning.
Amazon manages GPSR compliance through its «Manage your Compliance» dashboard in Seller Central (accessible via Performance > Account Health > Regulatory Compliance). There, Amazon requires three categories of information for each affected ASIN and each EU marketplace: first, the responsible person's name, postal address, and email — the EU-based contact legally required under Article 16 of the GPSR; second, the manufacturer's name, address, and contact details; and third, safety documentation — PDF user manuals or safety sheets (up to 10 MB), plus JPG images of the product and packaging showing safety warnings (uploaded as PS01 to PS06 variants). All documentation must be in the official language of the target marketplace — German for Amazon.de, French for Amazon.fr, Spanish for Amazon.es, and so on. A single English document does not satisfy all markets.
Amazon also periodically requests full technical documentation, including the risk assessment and Declaration of Conformity. Providing contact details in Seller Central is a necessary first step, but it is not sufficient by itself: you must have the complete technical file ready to produce within 10 days if Amazon or an EU authority requests it. Sellers who provide a responsible person's details but cannot back them with documentation are still non-compliant.
What the law says
Article 22 of Regulation (EU) 2023/988: Online marketplace providers must ensure that sellers using their platform meet GPSR requirements and must remove non-compliant products. This is the legal basis for Amazon's enforcement of GPSR compliance on its sellers. Article 9 requires the technical file to be available to authorities within 10 days of request.
Consequences of non-compliance
Immediate listing deactivation across all EU Amazon stores. Account suspension for repeated violations. Fines of up to €100,000 from EU authorities independently of Amazon's action. In Germany, serious intentional violations of the revised Product Safety Act (in force since 19 February 2026) can result in imprisonment of up to one year.
